In an era of public spending cut backs and reductions in police numbers it
is no surprise that the effectiveness of the police service will suffer. We have seen first hand evidence of these "efficiency savings" after being instructed to assist private clients establish their innocence following being prosecuted for offences such as murder, sexual assault and rape.
We found in most cases, that not only did the police fail to carry out some
basic investigative procedures, but those that they did complete were able to
be questioned and doubts cast upon their credibility when challenged in court.
The other most concerning element of our invlovement in criminal defence
cases is the lack of apparent effort on the clients defence team. Time after
time we witness very little or no pro active investigation by lawyers to mount
a robust defence for their client. Basic work such as locating independent
witnesses, recovering photographs and cctv evidence, discovering history
surrounding prosecution witnesses, obtaining character witness statements,
evaluating submitted police evidence in order to challenge police procedure,
these are just some of the issues we found that defence solicitors were not
even considering.
Yet when it comes to accidents in the workplace or insurance
claims, its seems that no stone is left unturned!
